Scott D. Cunningham

Scott represents international airlines, aircraft manufacturers and their insurers in complex litigation.

Scott heads the firm’s Los Angeles office and has extensive experience representing aerospace insurers, foreign and domestic airlines and aircraft manufacturers as lead counsel in cases involving wrongful death and personal injury. Scott is recognized for his work in the defense of several high-profile major air disaster cases and accident investigations, complex commercial litigation involving international air carriers, DVT Multidistrict litigation pending in California and the defense of IATA air carriers for alleged violation of the California Health and Safety Code, commonly known as the “Proposition 65″ litigation.

Scott has successfully handled a significant number of appeals in both state and federal courts and prepared several petitions for writs of certiorari to the U.S. Supreme Court.

Consistently recognized by The Legal 500, Aviation Expert Guides, Who’s Who Legal: Transport, and The International Who’s Who of Aviation Lawyers for his “extensive skill” and “enviable reputation” litigating on behalf of air carriers, manufacturers and insurers, Scott is also the recipient of the Corporate LiveWire Global Award in the category of Aerospace & Defence for Los Angeles, CA. Scott has been selected by his peers as a Southern California “Super Lawyer” and was also named a Southern California Super Lawyer “Rising Star.”

Scott is a frequent author and speaker on aviation law and trial practice. He is a graduate of the International Association of Defense Counsel (IADC) trial academy hosted every year at Stanford University.  Scott is a member of the Los Angeles County Bar Association, the American Bar Association (Editorial Board member 2005-2010 for the ABA Aviation Law Quarterly), and the State Bar of California. He is also a member of the Defense Research Institute.  In 2012, Scott was elected as a Committee Vice-Chairperson, Aviation Law, by the Inter-Pacific Bar Association.

Scott was invited to speak about the U.S. legal system for MBA students at INSEAD University in Singapore on February 6, 2009.

In the Wake of Husain: Air Carrier Liability after Olympic Airways v. Husain. Co-authored with John Maggio, Aviation Litigation Quarterly (Fall 2006).

Scott spoke on environmental litigation under California’s Proposition 65 at the 2007 IATA Legal Symposium which was held in Istanbul, Turkey, from February 12-14, 2007. Scott also presented the tenth volume of the IATA Liability Reporter.
